I don't see what the difference between either of the years would be, I don't believe the 22RE intake system underwent any changes during any year. As for which kit to go with I'd go with the cheaper one. If you think about it, all it is is a cone filter that takes more air in so they are both doing the exact same job.
Honestly, if you are into wheeling and gettin down and dirty, its not worth it to install the open element air filter. They are disigned more for runnin on the road, and even then water still gets on them!! The power gains are almost unoticable, just spend the money and install a K&N stock rectangular filter!
I regret getting the K&N FIPK kit for my 3.0 now that I'm playing in the mud/water more. I was even more foolish and threw away the old air box with the garbage years ago when I got tired of looking at it on the shelf

That's the damn truth. I hydrolocked my engine because of my open element. If you are going into a "it can't be that deep" puddle, don't even think about an open element. After destroying my engine the only cold air system I recommend is a snorkel if you are playing in puddles.
